Wrong Number Calls
Are you getting prerecorded or autodialed calls for someone else? Whether from a business contacting a current or former customer or a debt collector attempting to collect someone else's debt, just because the call isn't for you doesn't mean it isn't unwanted and harassing. Under the Telephone Consumer Protection Act of 1991 ("TCPA"), all calls made to a cell phone using an autodialer or automated/prerecorded message are illegal, unless the caller has the prior express consent of the called party. This includes calls to wrong numbers.
Consumers who receive unsolicited robocalls are entitled to a minimum of $500 per call, and even up to $1,500 per call where the violation was made willfully or knowingly, as well as injunctive relief to stop the telemarketing calls. It may even be appropriate to pursue a class action against the telemarketer or debt collector to bring its calling practices into compliance for all consumers.
